Terms of Service
WELCOME TO XENDMO
This contract is between you and Xendmo ("Xendmo," "we," "us," or "our"), and governs your use of our Services, which include the website, app, and any other materials produced by Xendmo. By creating a Xendmo Account, accessing our Services, or interacting with us, you agree to be bound by this Agreement and receive communications relating to the Services or your Xendmo Account in electronic format.
By using our Services, you affirm that you are at least eighteen (18) years old and legally allowed to enter into this Agreement. You expressly accept all the terms and conditions contained herein, including our Privacy Policy and Acceptable Use Policy. If you object to any part of these terms, you must refrain from using our Services.
This Agreement may include additional terms and conditions specific to certain Services. These supplementary terms will be communicated through the relevant Service or other means and will form part of this Agreement.
PURPOSE AND SCOPE OF AGREEMENT
This Terms of Service is an Agreement between you and Xendmo. It outlines the terms that govern your use of our platform and services, Xendmo’s obligations to you, and your responsibilities. It is important to carefully consider the risks associated with using the Services, as this Agreement is legally binding.
Xendmo enables you to swap Naira to Dollar, make payments via virtual cards, and manage currency balances. We reserve the right to refuse service, restrict account access, or terminate transactions at our discretion.
REGISTRATION
To use Xendmo, you must create an account by providing required information, such as your email address, full name, phone number, and any other details requested during registration. We may verify this information internally or through third-party services before approving your account.
You agree to notify us within 14 days of any changes to your registration details, such as your email address, phone number, or business information. If you contact us from an unregistered email or phone number, we may be unable to assist you.
KNOW YOUR CUSTOMER (KYC)
In compliance with Nigerian laws, including the Money Laundering (Prevention and Prohibition) Act, we are obligated to perform customer due diligence checks. You agree to provide accurate and up-to-date information promptly when requested.
Xendmo reserves the right to suspend or limit account access if these checks are incomplete or unsatisfactory.
ACCOUNT SECURITY
You are responsible for safeguarding your account credentials. Never share your password, OTP, or other sensitive information. If you suspect unauthorized access, immediately change your password and contact Xendmo support.
Xendmo may temporarily suspend your account if there are security concerns or suspected fraudulent activity.
AGE RESTRICTION
Xendmo’s Services are intended for individuals aged 18 and above. We do not knowingly provide services to individuals below this age threshold.
TRANSACTIONS AND PAYMENTS
Xendmo facilitates Naira-to-Dollar swaps and virtual card transactions. By using our Services, you confirm that:
All information provided for transactions is accurate.
You have sufficient funds for each transaction.
All transactions are final and irreversible unless otherwise required by Nigerian law, including the Consumer Protection Act 2018.
FEES AND CHARGES
You agree to pay all applicable fees as outlined on the Xendmo Pricing page. Fees may be revised with 24 hours' prior notice.
VIRTUAL CARDS
Xendmo provides virtual card services. Misuse or repeated insufficient funds transactions may result in account suspension or card termination. A new card issuance fee will apply for replacements.
INTELLECTUAL PROPERTY
All content on Xendmo’s website and app, including logos, trademarks, and software, is the property of Xendmo or its licensors. You may not copy, modify, or distribute any part of Xendmo’s intellectual property without written permission.
CONFIDENTIALITY
All information exchanged between you and Xendmo shall be treated as confidential, except where disclosure is required by Nigerian law, such as under the Cybercrimes (Prohibition, Prevention, Etc.) Act 2015.
LIABILITY AND INDEMNITY
Xendmo shall not be held liable for any losses arising from interruptions, errors, or unauthorized use of our Services. You agree to indemnify Xendmo against any claims or damages resulting from your breach of this Agreement or misuse of our Services.
TERMINATION
You may terminate this Agreement by closing your Xendmo account. We reserve the right to suspend or close accounts due to breach of terms, fraudulent activity, or legal requirements. Upon termination, any unrestricted funds will be made available for withdrawal.
HOW DO I CLOSE MY XENDMO ACCOUNT?
You may close your Xendmo account at any time by following these steps:
Log in to your account on the mobile app.
Navigate to More.
Select Delete your account.
Agree to the terms of service.
Tap the Continue with account deletion button.
Enter the reason for deleting your account and your account password.
Tap the Delete account button.
Pending Payments
If there are any pending transactions related to your Xendmo account when you initiate account deletion, your account will be closed promptly after such transactions are completed.
Remaining Balances
Before closing your account, ensure that all your currency balances are empty. Unused balances in your Xendmo account may be lost if not withdrawn, and Xendmo will not be liable for any such losses. To withdraw your funds:
Log in to your account on the mobile app.
On the homepage, select the currency you wish to withdraw funds from.
Tap the Withdraw button.
Choose Withdraw to a saved recipient or Withdraw to another account.
Fill in the required fields on the withdrawal form.
Tap the Continue button.
Review your transaction and tap the Finish button.
Repeat this process for each currency where you have a balance.
You must not close your Xendmo account to avoid an investigation. If you attempt to close your account during an investigation, Xendmo may hold your funds until the investigation is completed. You agree to remain responsible for all obligations related to your account even after closure. As a regulated financial institution, Xendmo is obligated to retain some of your data for purposes such as security, fraud prevention, accounting, reconciliation, anti-money laundering, and reporting.
DISPUTE RESOLUTION
In the event of a dispute between the parties related to this Agreement, the following resolution process will apply:
The parties will attempt to resolve the dispute amicably through mutual discussion and negotiation.
If no resolution is reached within 15 business days, the dispute will be referred to mediation. Both parties must agree on a mutually acceptable mediator.
The mediator's findings and subsequent agreement will be binding on both parties.
Each party will bear its own costs related to mediation.
ERRORS
With regard to your Xendmo account, the following constitute Errors:
Incorrect withdrawals or deposits into your account.
Transactions or transfers recorded incorrectly.
Incorrect amounts debited or credited.
Missing or unrecognized transactions in your account statement.
Computational or mathematical errors.
If you believe an Error has occurred, notify Xendmo promptly. Upon receipt of your complaint, Xendmo will investigate within ten (10) business days and rectify any errors promptly. If additional time is required, Xendmo may take up to 45 days to investigate but will provisionally credit your account within ten (10) business days for the disputed amount during the investigation.
SEVERABILITY
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable.
ASSIGNMENT
Xendmo reserves the right to assign, transfer, subcontract, or otherwise delegate its rights and obligations under this Agreement. You may not transfer or delegate any rights or obligations without Xendmo’s prior written consent.
REVERSALS AND CHARGEBACKS
If a transaction is invalidated, reversed, or refunded for any reason, you are responsible for the full amount of the transaction plus any applicable fees. Xendmo reserves the right to recover these funds through various means, including debiting your account or initiating a currency conversion to cover the amount.
UPDATES, MODIFICATIONS & ADJUSTMENTS
Xendmo may revise these terms periodically. Any changes will be reflected on this page, and material updates may also be communicated via email or service notifications. Continued use of Xendmo services after updates constitutes acceptance of the revised terms.
DATA PROTECTION
Xendmo complies with Nigerian data protection laws, including the Nigeria Data Protection Regulation (NDPR). For more details on how your personal information is collected and used, refer to Xendmo’s Privacy Policy.
THIRD-PARTY MATERIALS
Xendmo may provide access to third-party services or materials. Xendmo does not control, endorse, or accept liability for third-party materials. Use of such materials is at your own risk and subject to additional terms set by the third party.
